Brandon W. Marshall has worked in the criminal justice system for more than 25 years. Prior to joining forces with Patrick F. Nash to form Nash Marshall, PLLC, he worked as an Assistant United States Attorney and Director of Financial Litigation for the United States Attorney’s Office in the Eastern District of Kentucky. Brandon prosecuted matters including mortgage and healthcare fraud, kickbacks, tax fraud, banking crimes, computer offenses, crimes against children, prison and gang offenses, immigration cases, violent/firearm offenses, and many others. He routinely litigated complex matters and won numerous lengthy federal trials and appeals.
Brandon repeatedly participated in intensive litigation training at the United States Department of Justices’ National Advocacy Center in Columbia, South Carolina. He has an insider’s perspective on the Department of Justice’s latest computer forensic techniques, investigative methods, and trial and appellate tactics.
He has also been a frequent lecturer at national, regional, and local symposiums sponsored by the Department of Justice, including speeches on white collar sentencing, health care fraud, child pornography, and sex offender registration, among others. Mr. Marshall has presented numerous continuing legal education programs sponsored by the United States District Court and has been a recurrent guest lecturer at the University of Kentucky College of Law. He has also been invited to share his insights with employees of federal agencies, financial institutions, and the Kentucky Chapter of the Financial Institution Security Officers Association (FISOA).
Brandon has special interest and experience in federal sentencing laws. He worked for nearly ten years through the United States Probation and Pretrial Services Office, serving over half that time as a United States Sentencing Guideline Specialist and Supervisor of the Office’s flagship location in Lexington, Kentucky. In those roles, he advised federal judges and criminal litigators on the nuances of laws pertaining to sentence computation, alternatives to incarceration, restitution, fines, bail, supervision violations, diversion, and an array of other matters. Brandon now utilizes this knowledge to protect his clients’ rights during plea negotiations and other court proceedings.
He has notable experience in the areas of Federal Criminal Defense, White-Collar Defense, Defense of Professionals, Health Care Defense, Defense of Public Officials, Whistleblower Suits, Appellate Practice, Administrative & Civil Cases, and Subpoenas, Internal Investigations & Special Matters.
Brandon is a 1996 graduate of Centre College and a 1999 graduate of the University of Kentucky College of Law.
He is admitted to practice before all Kentucky courts, including the Kentucky Supreme Court. He is also admitted to practice before the United States District Courts in the Eastern and Western Districts of Kentucky, the District of Colorado, and the United States Court of Appeals for the Sixth Circuit.
